BIEN offers this website, including all information, tools and services available on it, to you, the user, on condition that you accept these terms and conditions (the “Terms and Conditions”) and the policies referred to in them.

By visiting this website and/or purchasing from us, you agree to be bound by these Terms and Conditions. They apply to all users of the website, including visitors, customers and contributors of content. If you do not agree with all of them, you will not be able to place an order.

New features or tools added to this website are also subject to these Terms and Conditions. The current version is always available on this page. We may update, change or replace any part of these Terms and Conditions by publishing the new version on this website. The version applicable to an order is the one in force on the date the order is placed.

Governing law and legal status of the products

These Terms and Conditions are governed by and construed in accordance with the laws of the Netherlands.

Psilocybin truffles are sold legally in the Netherlands, where BIEN is established. Their status varies from country to country: please check the legislation of your country.

Laws change frequently and differ between jurisdictions. We therefore make no statement about the legal status of our products outside the Netherlands and do not guarantee that they are available, suitable or permitted in any other country. Before ordering, it is your responsibility to inform yourself about the laws, import rules and customs regulations that apply at your delivery address.

1. Applicability

1.1. These Terms and Conditions apply to every offer made by BIEN and to every contract concluded between BIEN and the consumer.

1.2. Before the contract is concluded, the text of these Terms and Conditions is made available to the consumer on https://bien-microdose.com. The consumer must expressly accept them by ticking a box before placing an order.

1.3. Where specific product or service conditions apply in addition to these Terms and Conditions and the two conflict, the consumer may always rely on the provision that is most favourable to him or her.

2. The offer

2.1. If an offer has a limited period of validity or is subject to conditions, this is explicitly stated in the offer.

2.2. The offer contains a complete and accurate description of the products offered, detailed enough for the consumer to assess it properly. Images used by BIEN are a faithful representation of the products. Obvious mistakes or errors in the offer do not bind BIEN.

2.3. Each offer makes clear which rights and obligations are attached to its acceptance, in particular:

  • the price of the products, including applicable taxes;
  • any delivery costs;
  • the method of payment, delivery and performance of the order.

2.4. Each offer also states clearly that the products sold by BIEN:

  • are not medicinal products and are not intended to diagnose, treat, cure or prevent any disease;
  • must not be used for medical purposes, nor replace any medicinal product, medical treatment or medical advice;
  • must be used in accordance with the instructions and dosage indicated by BIEN;
  • must not be used by anyone under 18 years of age;
  • must not be used during pregnancy or breastfeeding;
  • must not be used in the situations described in article 3 (age and restrictions of use);
  • must not be used in case of colour blindness, in extreme situations or during traumatic events;
  • must not be combined with alcohol or other drugs;
  • must not be used before driving a vehicle or operating machinery.

2.5. If in any doubt, the consumer must consult a doctor before using the product.

3. Age and restrictions of use

3.1. Our products are reserved exclusively for adults aged 18 or over. Access to the website requires a declaration of age on entry, and every order requires the consumer to tick a mandatory box confirming that he or she is at least 18 years old.

3.2. This confirmation is recorded with a timestamp and kept together with the order, as evidence of the consumer's declaration. BIEN may refuse or cancel an order if there is reason to believe the consumer is under 18.

3.3. The use of our products is not recommended:

  • during pregnancy or breastfeeding;
  • in case of a personal or family history of psychiatric disorders, in particular psychotic or bipolar disorders;
  • when taking medication, in particular antidepressants or lithium;
  • in case of heart disease or cardiovascular conditions.

3.4. By placing an order, the consumer confirms having read these restrictions. BIEN makes no health claims about its products: no statement on this website should be read as a promise of any effect on health.

4. The contract

4.1. The contract between the consumer and BIEN is concluded when the consumer accepts the offer and places the order in accordance with the applicable conditions.

4.2. BIEN confirms receipt of the order electronically without delay.

4.3. BIEN takes appropriate technical and organisational measures to protect the electronic transfer of data and to provide a secure web environment, including for electronic payments. Within the limits of the law, BIEN may verify whether the consumer is able to meet his or her payment obligations, as well as any facts relevant to the responsible conclusion of a distance contract. If BIEN has valid reasons not to enter into the contract on that basis, it may refuse the order, stating its reasons, or attach special conditions to its performance.

4.4. BIEN sends the consumer the following information, in writing or on a durable medium that the consumer can store and access:

  • the e-mail address at which the consumer can submit complaints;
  • information about guarantees and after-sales service, if any.

5. No right of withdrawal

Because of the perishable nature of the products sold, the consumer has no right of withdrawal once the order has been placed. The consumer is informed of this before placing the order.

6. Price

6.1. During the period of validity stated in the offer, the prices of the products offered will not be increased, except for changes resulting from changes in VAT rates.

6.2. By way of exception, BIEN may offer products whose prices are subject to fluctuations in the financial market over which BIEN has no influence, at variable (“target”) prices. In that case, the offer states this explicitly.

6.3. All prices stated in the offer include VAT.

6.4. Discount codes are personal and cannot be transferred to other persons or other accounts, unless stated otherwise.

7. Delivery and performance

7.1. BIEN takes the greatest possible care when receiving and performing orders.

7.2. BIEN only delivers to the countries listed on the website at the time of the order. The place of delivery is the address the consumer has provided to BIEN.

7.3. BIEN performs accepted orders promptly and at the latest within 30 days of the order, unless a longer delivery period has been agreed. If delivery is delayed, or if an order cannot be performed or only partially, the consumer is informed no later than 30 days after placing the order. In that case, the consumer may terminate the contract free of charge and is entitled to a refund of any amount paid, without any further compensation.

7.4. If, for any reason, delivery of an ordered product proves impossible, BIEN will send the same product again as soon as reasonably possible.

7.5. The risk of damage to and/or loss of the products remains with BIEN until delivery to the consumer or to a representative designated in advance by the consumer and made known to BIEN, unless expressly agreed otherwise.

8. Conformity, warranty and legal status

8.1. BIEN warrants that the products comply with the contract, with the specifications stated in the offer, with reasonable requirements of reliability and usability, and with the Dutch legal provisions in force on the date the contract is concluded. Any guarantee offered by BIEN does not affect the statutory rights and remedies of the consumer.

8.2. Psilocybin truffles are sold legally in the Netherlands, where BIEN is established. Their status varies from country to country: please check the legislation of your country.

8.3. The consumer warrants that receiving and possessing the product is lawful in his or her country of delivery. BIEN only delivers to the countries listed on the website at the time of the order; the fact that a country is listed does not constitute any statement by BIEN about the legal status of the product in that country.

8.4. Reference is also made to the section “Governing law and legal status of the products” above.

9. Subscriptions and cancellation

9.1. Where BIEN offers the option of recurring deliveries (subscription), the consumer may cancel the subscription at any time by sending an e-mail to info@bien.health.

9.2. The following notice periods apply:

  • for weekly or monthly deliveries, a cancellation received by BIEN more than two (2) weeks before the next delivery date takes effect after the delivery preceding that date, and no further deliveries are made;
  • for deliveries every two or three months, a cancellation received by BIEN more than four (4) weeks before the next delivery date takes effect under the same conditions.

10. Payment

10.1. Payment is due immediately when the order is placed on the website. Payments are processed by PayPlug, a French payment service provider, using the payment methods offered at checkout (for example credit or debit card). BIEN does not store the consumer's full card details.

10.2. Where prepayment has been agreed, the consumer cannot claim any right regarding the performance of the order before the prepayment has been made.

10.3. The consumer must report any inaccuracy in the payment details provided or stated to BIEN without delay.

10.4. In case of payment default by the consumer, BIEN may terminate the contract after giving reasonable prior notice by e-mail and may charge the reasonable costs incurred as a result of the default, within the limits permitted by law.

11. Complaints

11.1. Complaints about the performance of the contract must be submitted to BIEN within a reasonable time, with a full and clear description, by e-mail to info@bien.health.

11.2. BIEN responds to complaints within 15 days of receipt. If a complaint requires a longer processing time, BIEN replies within 15 days with an acknowledgement of receipt and an indication of when the consumer can expect a more detailed answer.

12. Additional or different terms

Additional provisions or provisions that deviate from these Terms and Conditions may not be to the detriment of the consumer and must be recorded in writing or in a form the consumer can easily access.

13. Disputes

The competent court of Amsterdam, the Netherlands, has jurisdiction to settle any dispute arising from or in connection with these Terms and Conditions, without prejudice to the mandatory rules that protect consumers, in particular those of the country in which the consumer resides.
